A Smart Store sits on common elements, which makes it a Section 97 change under the Condominium Act. Under that section, the cost to the corporation determines who must approve the change. We structure the partnership so the corporation's cost is explicitly minimal, which keeps the decision with the board rather than triggering an owner vote.

In plain terms: because the corporation is not paying for the Smart Store, this is the kind of amenity a board can approve directly. We provide a one-page Section 97 note your board and counsel can review, and we are glad to work with your lawyer on the wording.
